HAWAIIDEED LLC — TEXT MESSAGING TERMS

These Text Messaging Terms govern the text messaging program operated by HawaiiDeed LLC ("HawaiiDeed," "we," "our," or "us"). These terms supplement our Terms of Service at www.hawaiideed.com/tos and our Privacy Policy at www.hawaiideed.com/privacypolicy.
1. Program Description
HawaiiDeed LLC sends one-to-one, two-way customer care text messages to individuals who have contacted our office about a Hawaii real property matter and who have consented to receive text messages at the number they provided.
Messages relate solely to your own inquiry and your correspondence with our office. Typically, we text you when our email reply to your inquiry has gone unanswered, in order to confirm that we have the correct email address for you or to ask how you would prefer to be contacted.
HawaiiDeed does not send marketing, promotional, or advertising text messages through this program.
2. How to Opt In
Consent to receive text messages is obtained in one of two ways:
Website form. By checking the text messaging consent box on our inquiry form and submitting the form, you agree to receive text messages from HawaiiDeed LLC at the number you provided. The consent box is unchecked by default and is separate from any acceptance of our Terms of Service or Privacy Policy.
Verbal consent by telephone. By affirmatively agreeing, during a telephone call to our office, to receive text messages at the number you have provided.
Consent is not a condition of contacting HawaiiDeed, of using our website, or of receiving any service. Acceptance of our Terms of Service does not constitute consent to receive text messages. We do not obtain telephone numbers or messaging consent from purchased lists, lead vendors, affiliates, or any other third party.
3. Automated Messaging Disclosure
Text messages in this program may be composed and sent by an automated assistant. The automated assistant identifies itself as automated in its first message to you.
Telephone calls to our office may also be answered by an automated assistant, which discloses that it is automated at the outset of the call.
You may ask at any time to communicate with a member of our team instead, and we will accommodate that request.
4. Message Frequency
Message frequency varies. Typically you will receive one to three messages per inquiry.
Messaging stops as soon as you reply, as soon as your inquiry is resolved, or as soon as you ask us to stop.
5. Cost
Message and data rates may apply. HawaiiDeed LLC does not charge for these messages; any charges are those imposed by your mobile carrier under your own plan.
6. How to Opt Out
Reply STOP to any message from us to be removed from the program. You will receive a single confirmation message, after which we will send you no further texts.

Opt-out requests are honored immediately and permanently. Opting out of text messages does not affect our ability to correspond with you by email, telephone, or mail, and does not affect any service you have requested.

8. Supported Carriers and Delivery
This program is supported on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
Message delivery depends on factors outside our control, including carrier filtering, network availability, and your device settings. Do not rely on text message for time-sensitive communication regarding any matter.
9. Messaging Hours
We send messages only between 8:00 a.m. and 7:00 p.m. in the time zone associated with your telephone number, Monday through Friday. Messages you send to us may be received at any time and will be reviewed during business hours.
10. Privacy
Mobile phone numbers and SMS consent collected by HawaiiDeed LLC are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.
No mobile information is shared with third parties or affiliates for their own marketing or promotional purposes under any circumstances. Mobile numbers are disclosed only to the communications service providers that transmit messages on our behalf, solely for that purpose.

11. No Legal Advice; No Attorney-Client Relationship
Text messages from HawaiiDeed LLC are administrative correspondence. Nothing sent by text message is or should be construed as legal advice.
Exchanging text messages with HawaiiDeed does not create an attorney-client relationship and does not obligate us to provide legal services. Until an attorney-client relationship is established by separate written engagement, information you send is not protected as a privileged attorney-client communication.
Please do not send sensitive, confidential, or time-critical information by text message. Text messages are not a secure channel, and we cannot know who else may have access to your device.
12. Changes to These Terms
We may update these Text Messaging Terms from time to time. The revised version will be posted on this page with an updated effective date.
